1. Acceptance of Terms

By downloading, installing, or using the VIBE: AI Video Generator application (“App”) or accessing the website at klingvideoai.app (“Website”), collectively referred to as the “Service,” you agree to be bound by these Terms of Service (“Terms”). The Service is operated by Rocket Digital Limited (“we,” “our,” or “us”).

2. Description of Service

VIBE is an AI video generator application that allows users to create videos from text prompts and images using various AI models. The Service includes free and premium subscription tiers (VIBE Pro).

3. Account Registration

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate, current, and complete information during registration.

4. Subscriptions and Payments

VIBE Pro subscriptions are billed through the Apple App Store or Google Play Store and managed by RevenueCat. Subscription terms, pricing, and renewal policies are presented at the time of purchase. Refunds are handled per the respective app store's refund policy.

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
You can manage or cancel your subscription in your device's app store settings.
Free-tier users may see advertisements served by Google AdMob.

5. Acceptable Use

You agree not to use the Service to:

Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
Create deepfakes, non-consensual intimate imagery, or content that impersonates real individuals without permission
Produce content that exploits minors in any way
Violate any applicable laws, regulations, or third-party rights
Attempt to reverse-engineer, decompile, or extract the AI models, algorithms, or source code
Use automated systems to abuse the Service or circumvent usage limits
Resell, sublicense, or redistribute access to the Service without authorization

6. AI-Generated Content

Content generated using the Service (“Generated Content”) is created by AI models from various providers including OpenAI, Google, and others. You acknowledge that:

Generated Content may not be unique and similar outputs may be produced for other users
We do not guarantee the accuracy, quality, or appropriateness of Generated Content
Subject to these Terms and your subscription tier, you may use Generated Content for personal and, for VIBE Pro subscribers, commercial purposes
You are responsible for ensuring your use of Generated Content complies with applicable laws and the terms of the underlying AI model providers

7. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by Rocket Digital Limited and protected by intellectual property laws. You retain ownership of the input content (prompts and images) you provide. The ownership and licensing of AI-Generated Content is subject to the terms of the underlying AI model providers.

8. Third-Party Services

The Service integrates with third-party services including Firebase, RevenueCat, Google AdMob, OpenAI, Microsoft Azure, Replicate, and Fal.ai. Your use of these integrated services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI MODELS AND THEIR OUTPUTS MAY CHANGE WITHOUT NOTICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROCKET DIGITAL LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your access to the Service at our discretion if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by nature should survive termination will remain in effect.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes shall be resolved in the courts of Hong Kong.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or Website. Your continued use of the Service after changes constitutes acceptance.
